By submitting Booking the form I am agreeing to be bound by the below terms.

AGREEMENT OVERVIEW: This Agreement expresses the full and complete agreement between the CLIENTS (Hereafter referred to as CLIENTS) and PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH (Hereafter referred to as PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH) regarding the subject matter hereof. It supersedes all prior agreements. The only way to add or change this agreement is to do so in writing, signed by all parties.

COOPERATION: Unless otherwise noted PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH, it's associates or employees will be the exclusive photographer(s) at this Family/Portrait photography shoot. The CLIENTS agree that good faith cooperation and communication between them is important in obtaining a good result. CLIENTS must also notify PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH and photographer(s) in writing if they wish to have anything photographed in a particular way. PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH or the photographer(s) will not be held accountable for not photographing desired portraits if there is no one to assist in identifying these details and photographs on the day. PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH is not responsible if key individuals fail to appear or co-operate during the photography session, or for missed images due to details not revealed to PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH or factors beyond the photographer(s) control.

MEDICAL INFORMATION: It's upon the client (you) to notify PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH if you or the people you bring to the session are photosensitive, special needs or any other medical issues where the photographer would need to know to be able to complete a session. This is upon your discretion to disclose all & any information to the photographer. PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH takes no responsibility for the client (you) or whom you bring to the session, for any medical issues which arise if you hadn't already disclosed this information in the agreement. PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH takes no responsibility. 

HOUSE RULES: If CLIENT appears under the influence of alcohol or drugs during the shoot, PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH has the right to cancel the shoot immediately due to liability and health concerns arising.

IMAGES and COPYRIGHTS: Photographs/images produced by PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH are protected by Copyright Law (all rights reserved). Upon final payment by CLIENTS, CLIENTS can display resulting images for personal use. Said images may not be altered or reproduced in any manner without prior written permission of PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH. CLIENTS will receive online access to high resolution digital images with printing rights. When publishing the photos socially or commercially, PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH must be noted as the photographer. The CLIENTS must obtain written permission from PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH prior to the CLIENTS, there associates, friends or relatives selling the photographs. 

MODEL RELEASE: The CLIENTS hereby grant to PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH and successors, heirs, executors, administrators, assigns, attorneys, representatives and agents, the irrevocable and unrestricted right to use and publish photographs of the CLIENTS or in which the CLIENTS may be included, for editorial, trade, advertising or any other purpose and in any manner or medium; to alter the same without restriction; and to copyright the same. The CLIENTS hereby release PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH and all associates, representatives and assigns from any and all claims, actions, demands, suits, liabilities, damages, expenses, and obligations of any kind arising from, or related in any manner to PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH use of said images.

RETAINER & PAYMENT SCHEDULE: All sessions include a NON-REFUNDABLE RETAINER.
All session fee have a NON-REFUNDABLE RETAINER of $200 which is due at the signing of this agreement. Mini sessions NON-REFUNDABLE RETAINER of $100 which is due at the signing of this agreement. All Weddings are $400 NON-REFUNDABLE RETAINER which is due at the signing of this agreement - this payment is included in your Wedding package - only Weddings. PLEASE NOTE this is a NON-REFUNDABLE RETAINER booking fee NO MATTER IF YOUR SICK OR ILL. Should CLIENT not show up to the scheduled appointment, cancel the appointment, reschedule, not wanting final images or otherwise breach this Agreement, the NON-REFUNDABLE RETAINER shall be liquidated for damages each time to PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH. The NON-REFUNDABLE OF YOUR PAYMENT is to cover either some or all of the following, Photographers Time, Talent, Materials/Charges, Studio, Hires, Flights, Hire car, Parking, Booking Prints, Albums, Online Gallery, Dropbox album, Emails, Invoices, Website, 3rd party, and more, incurred up to the time of cancellation. Otherwise, the retainer shall be applied towards the Final Total, with the remainder of charges payable in full, prior to the photo shoot. If extras are added on the day of the photo shoot, payments must be paid before the images are provided to CLIENTS.

LIMIT OF LIABILITY: In the unlikely event that the photographer(s) are injured, become too ill, or has an emergency that prevents them from photographing the event/session, PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH will contact the CLIENT as soon as possible, to arrange another suitable date and time. Please note if photographer PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH must reschedule the session due to illness, weather, equipment malfunction, fire, personal circumstances, then the session will be re-scheduled later. This does NOT qualify for a full refund. By agreeing to this contract, you agree that you THE CLIENT can be flexible in changing the session date & time which both suits you THE CLIENT and PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH. The photographer PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH is not liable for DISRUPTIONS OR COSTS for any third-party appointments which THE CLIENT has booked on the day of the session. 

PROCESSING IMAGES: PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH takes the utmost care with respect to exposure, storage, and processing the photographs/images, but cannot and does not, guarantee that photographs/images of the event will not be lost, stolen, or destroyed for reasons within or beyond PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH control. CLIENT agrees that PHOTOGRAPHY AND FILM BY HANNAH ELIZABETH or the photographer(s) full and complete responsibility and liability is limited to the return of all payments received for the event.

Photography and Film by Hannah Elizabeth understands that you care how your personal information is used and shared. Whilst we appreciate you trust we will do so carefully and sensibly, Photography and Film by Hannah Elizabeth is also obliged to comply with the requirements of the Federal Government's National Privacy Policy, in accordance with the Privacy Act 1988 (Act). 


This document comprises our Privacy Policy. 


This Privacy Policy incorporates information on how Photography and Film by Hannah Elizabeth collects, uses, discloses and keeps secure your personal information. 


 
 

1.         Collection of Personal Information
 

(a)        The information collected by Photography and Film by Hannah Elizabeth from you assists us in personalising and improving the experience for our customers. Such information is utilised primarily to ensure supply of goods and services to you the customer. Such information includes: 


(i)         name and address; 


(ii)        contact phone number; 


(iii)       email address; 


(iv)       product preferences; 


(v)        information regarding promotions and other service of Photography and Film by Hannah Elizabeth; and
 

(vi)       information pertaining to all events and/or membership components. 


 
 

(b)        Information regarding your use of the Photography and Film by Hannah Elizabeth website may also be obtained through the use of cookies. 


(c)       Photography and Film by Hannah Elizabeth will not collect sensitive information without your consent, unless it is necessary for such information to be collected for an activity or function, and will not collect any such information in a secret or dishonest way.

2.         Use of Personal Information
 

(a)        The primary use of personal information is for the purposes listed under the heading, Collection of Personal Information, above. However, we will use and disclose your personal information for the approved purposes and in a variety of ways associated with the approved purposes, including the following:
 

(i)         to assist in the development of information technology, systems maintenance and development; 


(ii)        to assist in the development of information technology requirements, systems maintenance and developmental issues; 


(iii)       to analyse information for product development, marketing and research purposes and to improve and extend our range of services; 


(iv)       to investigate and resolve complaints concerning the provision of services by us or others associated to us; 


(v)        marketing directly to you in accordance with the National Privacy Principals; 


(vi)       disclosure of your personal information to any other organisation or person involved in carrying out any necessary function or activity on our behalf, including complaints handling and fraud prevention, whether within Australia or overseas; 


(vii)      disclosure of your personal information in a manner authorised or required by law; 


(viii)     for any unrelated secondary purpose to which you consent; and
 

(ix)       for compliance with any legislative and regulatory provisions
 

(b)        Moreover, we shall not utilise personal information without taking reasonable steps to ensure that the information is accurate, complete and up to date. 


 
 

3.         Disclosure of Personal Information
 

Photography and Film by Hannah Elizabeth may use and disclose your personal information for approved purposes and in a variety of ways associated with approved purposes. This includes the following: 


(a)     Photography and Film by Hannah Elizabeth may disclose personal information to related or unrelated third parties if consent has been obtained from you. 
 

(b)       Photography and Film by Hannah Elizabeth may disclose personal information between related body corporates. In circumstances where information is disclosed to related body corporates, they are bound by the original primary purpose for which the information was collected. 


(c)       Photography and Film by Hannah Elizabeth may disclose personal information to unrelated third parties to enable outsourcing of functions for purposes including, but not limited to billing, customer relations management and order fulfillment. This will be done when such disclosure is within your reasonable expectations. 


(d)        Photography and Film by Hannah Elizabeth will take reasonable steps to ensure that its contracts with third parties include requirements for third parties to comply with the Use and Disclosure requirements of the Privacy Act, and in accordance with the Photography and Film by Hannah Elizabeth Privacy Policy.
 

(e)        Photography and Film by Hannah Elizabeth may disclose personal information to law enforcement agencies, government agencies, Courts or external advisors where permitted or required by law. 


(f)         Photography and Film by Hannah Elizabeth may disclose personal information to avoid an imminent threat to a personís life or to public safety.
 

(g)        If disclosure is not for a primary purpose, then it is for a related secondary purpose. If disclosure has not been obtained, then Photography and Film by Hannah Elizabeth will not disclose your personal information, unless for the reasons documented at clauses 3(a) to 3(f).  
 

(h)       Photography and Film by Hannah Elizabeth does not generally sell or share its customer lists on a commercial basis with third parties, but in the event that we did, it would be done only if the appropriate consent of the individuals have been obtained. In this circumstance, Photography and Film by Hannah Elizabeth will take steps to ensure that the use of its customer list by the third party does not exceed the scope of the content. 


 
 

4.         Security and Quality of your Personal Information
 

Photography and Film by Hannah Elizabeth will take reasonable steps to ensure that any of your personal information that is collected, stored, used or disclosed by us is accurate, complete and up-to-date. To do so, Photography and Film by Hannah Elizabeth shall do the following: 


(a)       Photography and Film by Hannah Elizabeth will review its collection and storage practices on a regular and ongoing basis to determine how improvements to accuracy can be achieved. 


(b)      Photography and Film by Hannah Elizabeth requires its employees and contractors to perform their duties in a manner that is congruent with our legal responsibilities in relation to privacy.  
 

(c)      Photography and Film by Hannah Elizabeth will take all reasonable steps to ensure that all paper and electronic records that contain personal information will be stored in a facility that will not allow unauthorised access. 


(d)        Photography and Film by Hannah Elizabeth will review its information security practices on a regular and ongoing basis to determine how improvements to security can be achieved. 


 
 5.         Access of Personal Information
 

Photography and Film by Hannah Elizabeth shall take reasonable steps to limit access to personal information by doing the following: 


(a)        Photography and Film by Hannah Elizabeth will allow access to personal information records by the relevant individual, should such requested access be in accordance with the Privacy Act.  
 

(b)        Photography and Film by Hannah Elizabeth will correct its personal information at the request of the individual concerned as soon as practicable, and in accordance with the Privacy Act. Should an individual wish to correct their personal information, they should contact Photography and Film by Hannah Elizabeth directly. 


(c)       Photography and Film by Hannah Elizabeth may charge a fee for process of an access request if such a request is complex or resource intensive. 

6.         Cookies and other technologies
 

(a)        As is standard practice on many corporate websites, Photography and Film by Hannah Elizabeth utilises cookies and other technologies to assist us in determining what components of our website are most popular, and to ensure that our online advertising is bringing customers to our products and services. Cookies may also be utilised to study traffic patterns and most importantly, to ensure that your experience in interacting with us is convenient. 


(b)       Photography and Film by Hannah Elizabeth advises that it does not typically utilise this information collected for any purpose beyond the scope of this Privacy Policy. 


7.         Are Your Personal Account Details Stored Safely?
 

Photography and Film by Hannah Elizabeth shall take reasonable steps to ensure the security of personal information held by it from such risks as loss or unauthorised access, destruction, use, modification or disclosure of data. Photography and Film by Hannah Elizabeth only permits your details to be accessed by authorised personnel. 


8.         Openness 


(a)        Should you have an inquiry or complaint regarding privacy or our privacy policy, we request there be referred to Photography and Film by Hannah Elizabeth at photographybyhannahelizabethau@gmail.com

(b)        Photography and Film by Hannah Elizabeth will have its Privacy Policy and Terms and Conditions prominently posted on its website.
